Abstract

Dr Lucas Roorda The Netherlands often prides itself on being a forerunner in human rights promotion and human rights compliance, being a signatory to most human rights instruments and often at the forefront of promoting human rights compliance. Whether or not that is correct or merely well-intentioned self-flattery, human rights play an important role in the Dutch legal system and the Dutch courts have certainly seen their fair share of human rights and human rights-related litigation. This litigation has partially taken the form of civil lawsuits, in particular wrongful act suits – sometimes against the Dutch State itself but also against non-state entities. These lawsuits are the subject of this contribution, which examines the role of wrongful act law in enforcing human rights in the Netherlands. This chapter consists of two sections.
