The Facebook judge? How transparency in social media conflicts with the Rule of Law

Abstract

The theoretical discussion regarding the Rule of Law predominantly focuses on two readings: the formal and the procedural reading. This paper foregrounds a third reading. The Rule of Law is also read as a modernist emblem framing the ongoing competition for the right to determine the law. The emblematic reading explains the persistent format of the written judicial decision, exclusively symbolizing the formal reading of the Rule of Law.
