Abstract

In a complex economy like that of the Netherlands in which numerous transactions take place. very few conflicts enter the legal system en even less come before a Judge. Usually, there is no time and attention to fight out legal battles. At the same time the prevailing view is that law and judiciary enable a market economy to function and guide the behaviour of the actors. In this address this apparent contradiction is explored, using the outcomes of diverse empirical research and new data about court cases.
