Abstract

This entry considers the role of article XX GATT as a general exemption for environmental measures found to violate states’ substantive GATT obligations. Sketching the provision’s evolving interpretation, it reflects upon the balance sought between respect for GATT obligations and states’ regulatory autonomy to protect the environment.
